Welcome to VillageRaise. These Terms of Use ("Terms") constitute a legally binding agreement between you and VillageRaise governing your access to and use of the VillageRaise application ("the App") at villageraise.app and any related platforms or services.
By accessing or using VillageRaise, you acknowledge that you have read, understood, and agree to be bound by these Terms in their entirety. If you do not agree to these Terms, you must immediately cease all use of the App.
You represent and warrant that you are at least 18 years of age, have the legal capacity to enter into a binding agreement, and are using the App for your own personal, non-commercial parenting support purposes. Use of the App on behalf of another person without their knowledge is prohibited.
We reserve the right to modify these Terms at any time without prior notice. Continued use of the App following any modification constitutes your binding acceptance of the revised Terms.
VillageRaise is a technology platform that uses artificial intelligence to provide general parenting support information and conversation guidance. Understanding what VillageRaise is NOT is essential before using this App.
VillageRaise IS NOT AND SHALL NEVER BE CONSTRUED AS:
All guidance provided by VillageRaise is general informational content only. It does not constitute professional advice of any kind. No user-provider, therapist-patient, attorney-client, or any other professional relationship is created by your use of this App under any circumstances.
You expressly acknowledge that any reliance on guidance provided by VillageRaise is entirely at your own risk. VillageRaise expressly disclaims all responsibility for any parenting decisions, actions, conversations, or outcomes that result from your use of the App.
If you or your child are experiencing a mental health emergency, crisis, or any situation involving risk of harm, contact emergency services (911), the 988 Suicide and Crisis Lifeline (call or text 988), or the Crisis Text Line (text HOME to 741741) immediately. Do not rely on this App in an emergency.
VillageRaise uses the Anthropic Claude AI model to generate all guidance, conversation starters, and resource suggestions. By using the App you expressly acknowledge and irrevocably agree that:
VillageRaise makes no warranties, express or implied, regarding the accuracy, reliability, completeness, suitability, or appropriateness of any AI-generated content for any purpose. All AI-generated content is provided strictly "as is."
VillageRaise and all of its constituent elements are the exclusive proprietary property of VillageRaise and are protected under United States and international intellectual property laws, including copyright, trademark, trade secret, and patent laws. All rights are expressly reserved.
Proprietary elements include without limitation:
No license, express or implied, is granted to any party to use, copy, reproduce, modify, distribute, display, or create derivative works from any VillageRaise proprietary technology or intellectual property without prior written authorization from VillageRaise.
Any unauthorized use, reproduction, imitation, or commercial exploitation of VillageRaise intellectual property will be pursued to the fullest extent available under applicable law, including injunctive relief, actual damages, statutory damages, and attorney fees.
You retain ownership of the personal situation descriptions and profile information you enter into the App. By submitting content, you grant VillageRaise a limited, non-exclusive, royalty-free license to process that content solely for the purpose of generating your requested guidance response. This license does not permit VillageRaise to sell, publish, or otherwise commercially exploit your personal inputs.
Your right to access VillageRaise is conditioned on your strict compliance with these Terms. You agree to use the App solely for its intended purpose of personal, non-commercial parenting support for your own household. Any other use is expressly prohibited without prior written consent from VillageRaise.
You expressly agree that you will NOT, under any circumstances:
Any violation of these prohibitions constitutes a material breach of these Terms and may constitute a violation of applicable law. We reserve the right, at our sole discretion and without prior notice or liability, to immediately and permanently terminate your access to VillageRaise for any violation. We further expressly reserve all rights to pursue civil and criminal legal remedies to the fullest extent permitted by law for any violation that causes harm to VillageRaise, its users, or third parties, including but not limited to injunctive relief, compensatory damages, punitive damages, and attorney fees.
VillageRaise offers a free tier that includes a limited number of guidance sessions at our sole discretion. The number of free sessions, and the features available in the free tier, may be changed at any time without notice. Circumventing free tier limits by any means is a material breach of these Terms.
VillageRaise offers a paid subscription for unlimited guidance sessions at $6.99 per month. By subscribing you authorize VillageRaise to charge your payment method on a recurring monthly basis automatically until you cancel. You are responsible for all charges incurred under your account.
You may cancel your subscription at any time through the App or by contacting us at villageraiseapp@gmail.com. Cancellation takes effect at the end of the current billing period. Access continues through the end of the paid period. We do not offer partial refunds for unused portions of any billing period.
All sales are final except where expressly required by applicable law. We do not offer discretionary refunds. If you believe you have been charged in error, you must contact us at villageraiseapp@gmail.com within 30 days of the charge with documentation of the error. Chargebacks initiated without first contacting us constitute a breach of these Terms.
We reserve the right to change subscription pricing at any time with at least 30 days written notice to active subscribers. Continued use after a price change takes effect constitutes acceptance of the new pricing.
Your use of VillageRaise is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the App, you agree to the data practices described in our Privacy Policy.
You acknowledge that situation descriptions you submit are transmitted to Anthropic, PBC for AI processing. You accept sole responsibility for any information you choose to include in your submissions. Do not include full names, addresses, social security numbers, financial information, protected health information, or any information you would not want transmitted over the internet.
VillageRaise is provided strictly on an "as is" and "as available" basis without any warranties of any kind, either express or implied, to the fullest extent permitted by applicable law.
VillageRaise expressly disclaims all warranties including without limitation: any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage of trade.
VillageRaise makes no warranty that: (a) the App will meet your requirements; (b) the App will be uninterrupted, timely, secure, or error-free; (c) any guidance will be accurate, reliable, complete, or appropriate; (d) any defects will be corrected; or (e) the App or its servers are free of viruses or harmful components.
To the maximum extent permitted by applicable law, VillageRaise and its owners, operators, employees, agents, licensors, and affiliates shall not be liable under any theory of liability — whether contract, tort, negligence, strict liability, or otherwise — for any damages of any kind arising from or related to your use of or inability to use the App, including without limitation:
This limitation applies regardless of whether VillageRaise has been advised of the possibility of such damages and regardless of the failure of essential purpose of any limited remedy.
In no event shall the total cumulative liability of VillageRaise to you for all claims arising out of or related to these Terms or the App exceed the greater of: (a) the total amount you paid to VillageRaise in the three months immediately preceding the claim, or (b) ten dollars ($10.00 USD).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability. In such jurisdictions, our liability shall be limited to the maximum extent permitted by applicable law.
To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless VillageRaise and its owners, operators, employees, agents, licensors, successors, and assigns (collectively "VillageRaise Parties") from and against any and all claims, actions, demands, suits, proceedings, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees and court costs) arising out of or relating to:
VillageRaise reserves the right to assume exclusive control of the defense of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with VillageRaise in asserting any available defenses. This indemnification obligation survives the termination of these Terms and your use of the App.
These Terms and any dispute arising from your use of VillageRaise shall be governed exclusively by the laws of the State of Utah, United States of America, without regard to its conflict of law provisions or the United Nations Convention on Contracts for the International Sale of Goods.
Any legal action or proceeding relating to these Terms or the App shall be brought exclusively in the state or federal courts located in Utah, and you hereby irrevocably consent to the personal jurisdiction and venue of such courts.
Before initiating any legal action, you agree to first contact us at villageraiseapp@gmail.com and provide written notice of your claim. You agree to engage in good-faith negotiations for a minimum of 30 days before filing any claim.
If any provision of these Terms is found by a court of competent jurisdiction to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and VillageRaise with respect to the App and supersede all prior agreements, representations, and understandings of any kind.
